1a) Upon signing this agreement I acknowledge that I am the owner or lessee of this bitch and I have the legal right to breed her.
aa) As owner or lessee of this bitch, I will provide a copy of AKC registration or lease agreement prior to, or at the time of breeding demonstrating legal right to breed said bitch.
b) I also acknowledge that this bitch is at least 22 months of age and less than 7 yrs old at the time that the breeding takes place.
c)The bitch owner will present copies/proof of genetic testing in advance of breeding which demonstrates the bitch is clear of the following genetic disorders:
c.1) Hip Dysplasia
c.2) Elbow Dysplasia
c.3) PRA - either Optigen test, or cleared via parentage
Preliminary results are acceptable for hips and elbows.
d) I agree that I am capable of caring for the bitch and her litter which includes vet care, food, water and proper shelter.
2a)Bitch owner acknowledges that should a litter occur from this breeding that it will not result in the bitch owner producing over a total number of 8 litters in a 24 month period either owner or co-owned.
3a) The owner of the bitch agrees to pay the stud owner a stud fee of $2,500.00 for a full litter.
b) The stud owner is not obligated to sign the litter registration until the stud fee is paid.
c) The stud fee will be paid upon sale of the 3rd puppy sold, at the latest.
d) Four puppies constitutes a full litter. If one puppy is born $500.00 shall be paid to the stud owner. If two puppies are born $1,000.00 shall be paid. If three puppies are born $1,500.00 shall be paid. These lesser amounts are in direct proportion to the stud fee of a full litter of four or more puppies.
e) Breeder agrees to have all puppies examined by a vet, vaccinated, and dewormed before placement with new owners.
4a) The owner of the bitch agrees to pay all expenses incurred for this breeding. This includes cost for artificial insemination, semen collection and checking/counting (fresh, chilled, frozen) and the shipping of the semen. This also includes any and all travel expenses where the stud dog owner must travel greater than 100 miles per insemination trip.
4b)The bitch owner agrees to pay a $300.00 non-refundable deposit. If the breeding takes the deposit will be deducted from the stud fee. If frozen semen is used an additional $250.00 will be due at the time of breeding for a total deposit of $550.00
5a) It is the option of the stud dog owner to choose between the stud fee, or pick of the litter. If the stud dog owner chooses a puppy in lieu of the stud fee, then the stud owner will have first pick of the litter before any other picks are made. Pick puppy will be made at 8 weeks of age. If only one bitch is born in the litter, the breeder will have right of first refusal of that bitch. If two or more bitches are born, then the stud dog owner will have first pick.
b)The stud dog owner(s) has the right to use their kennel name on the puppy should they choose to do so.
6) The bitch owner will have the bitch tested for both Brucellosis and Canine Herpes virus prior to this breeding, but of a time period no greater than 2 weeks prior to breeding.
7a) The bitch owner also agrees that they will not sell or transfer ownership of any puppies from said litter to any person or organization whose intent is to resell, trade, or give the puppy away for use in laboratory testing.
b)The bitch owner also agrees that they will not sell, trade or give away any puppy resulting from the breeding to a known puppy mill or person who's sole intention is to breed and produce litters from this dog.
c)The bitch owner also agrees to sell or place each puppy with a written contract.
d)The bitch owner (breeder) agrees to be responsible for the offspring of this litter and to take puppies back if necessary.
8) As mastiff breeders dedicated to this breed we acknowledged our responsibility to breed only the best specimens to compliment the betterment of out breed.
9) By signing this agreement, the Stud Dog owner certifies that no material changes to this contract have been intentionally inserted for the purpose of defrauding or gaining an unfair advantage to the above and below signed breeder since the time of the original communication of the Stud Dog Contract.
9a) If any additions are discovered that were inserted after the original communication of the Stud Dog contract that are not acceptable by the breeder - and are deemed material by the breeder, then the breeder will not be required to honor these changes. This clause recognizes that this contract is a "living document," and may be changed from time to time in order to further protect all parties involved.
10) This agreement is hereby entered into and wholly executed in the State of Pennsylvania and any litigation arising from any possible breach of this agreement shall be adjudicated in the County of Bucks in the State/Commonwealth of Pennsylvania, under Pennsylvania law. All parties hereby submit themselves to to the jurisdiction of said courts. Should any provision of this agreement be held invalid, illegal or unenforceable, the remaining provisions of this contract will not be affected.
11)I/We fully understand the terms of this contract and acknowledge that it is a binding contract. By signing this contract I/We agree to abide by its terms and conditions. Initial _____________
